Section 0: Supremacy Clause
This Master Service Agreement (MSA) and Acceptable Use Policy (AUP) constitute the primary legal framework of Valiva Polmane Infrastructure S.p.A. In the event of any conflict between this document and any other agreement, purchase order, or communication, **this policy shall prevail**.
01. B2B INFRASTRUCTURE SCOPE
Valiva Polmane is strictly a **B2B Infrastructure Provider**. We do not provide services to individual consumers, hobbyists, or non-verified commercial entities. Our gateway is engineered for Enterprise Resource Planning (ERP) integration and large-scale logistical operations.

02. TRANSACTIONAL INTEGRITY MANDATE
Valiva Polmane prohibits the use of its infrastructure for any marketing or promotional purposes. Transactional messages are defined as communications triggered by a user action or a critical system event.
Permitted Content
Proof of Delivery (POD), System Alerts, Password Resets, Critical Telemetry, Invoices, and Legal Notices.
Prohibited Content
Newsletters, Discounts, Warm-up Traffic, Lead Generation, and Cold Outreach of any nature.
03. PARTNER VERIFICATION & AUDIT RIGHTS
All Partner accounts require **Manual Human Verification**. We reserve the absolute right to audit a Partner’s data collection methods. Partners must maintain Double Opt-In (DOI) logs or explicit contractual proof for every recipient and provide such records to Valiva Polmane within 24 hours upon request.
04. TECHNICAL RFC COMPLIANCE
Every message dispatched through our gateway must comply with **RFC 5321 (SMTP)** and **RFC 5322 (Internet Message Format)**. Additionally:
- Mandatory SPF/DKIM Alignment
- Valid DMARC Record Required (p=quarantine/reject)
- Pre-emptive Suppression of Hard-Bounces (>24h)
05. INDEMNIFICATION & LIABILITY
The Partner shall indemnify, defend, and hold harmless Valiva Polmane Infrastructure S.p.A. against any and all claims, fines, or damages resulting from the Partner’s breach of this Policy. This includes, without limitation, fines imposed by Internet Service Providers (ISPs) or regulatory bodies (e.g., AgCom, FTC).
